Border Patrol agent’s rape trial begins

A U.S. Border Patrol agent is on trial this week, accused of raping another agent. His defense attorney told jurors Tuesday that the charges stem from the alleged victim telling a lie she couldn’t get out of.

The alleged victim had four beers and decided to spend the night at a fellow agent’s house rather than drive home, Eazer said. Dick sent his girlfriend home and went to the same agent’s house, where he shared a 12-pack of beer with the agent whose house they were at, she said.

At about 2 a.m., Eazer said, the woman awakened to find someone pulling her pants down and climbing on top of her. She realized it was Dick when he told her he wanted to know if she was a good kisser, Eazer said.

The woman tried to push Dick off, but he restrained both of her hands above her head with one hand and raped her, Eazer said. He then fell asleep.

The prosecutor said the entire incident took less than one minute and was so shocking to the woman that she did not scream or call for help.

After the incident, the woman dressed, went to her car and called a friend and 911.

Dick gave authorities three statements that were, at times, confusing, contradictory and nonsensical, Eazer said.

Defense attorney Rick Lougee told jurors that the woman initiated the encounter but soon realized a man she was interested in might find out because his brother is also an agent. Being an agent, the woman likely felt that she had no choice but to follow through with her story, Lougee said.

The defense attorney also questioned whether a certain turn of phrase was a coincidence. Lougee told jurors the woman told her new boyfriend in the days before the incident that he was a “good kisser,” Lougee said.

She used the same words when she was pushed for details about the incident, but she put the words in Dick’s mouth, Lougee said.

The defense attorney also said it would be physically impossible for the incident to have happened the way she described it.

The trial is being presided over by Judge Charles Sabalos.
