Gaxiola escapes the death penalty for murdering 9 year old Brisenia Flores & father Raul

After a jury earlier could not decide on the appropriate punishment for Albert Gaxiola for the murder of 9 year old Brisenia Flores in May of 2009, Judge John S. Leonardo, during a hearing Friday, granted a prosecution motion withdrawing the death notice during a hearing Friday morning. Deputy County Attorney Rick Unklesbay told Leonardo that the Homicide Panel in his office has reviewed all the pros and cons of continuing to seek the death penalty for Brisenias murder, and with the full understanding and support of victim and mother Gina Gonzalez, the prosecution was taking the death penalty off the table.
