The 9th U.S. Circuit Court of Appeals rejected arguments by nativist Sen. Russell Pearce, R-Mesa, that he has a “unique perspective” on SB 1070. Pearce, through his attorneys, said he wants a chance to convince the appellate judges that all provisions of the law are legal. Pearce wants to try to convince the appellate court that U.S. District Judge Susan Bolton, whom he calls “an activist judge looking for an appointment to the 9th Circuit,” was wrong when she enjoined the state from enforcing most of the key provisions of the draconian law. Eric Larsen, attorney for Minuteman and accused child killer Shawna Forde was back in court last week with another handful of motions, this time, trying to preclude the statements of two Colorado Minutemen and FBI informants from being used in her January 2011 trial. The still unidentified Minutemen told the FBI that Forde met with them in Colorado a couple of months prior to the murders in Arivaca to discuss her plans and need for the proceeds to fund her border vigilante Minuteman group. Forde tried to recruit the two to help her, but fortunately for them, they refused and contacted authorities. The 3rd U.S. Circuit Court of Appeals in Philadelphia, ruled Thursday that Hazleton, Pa., may not enforce its Illegal Immigration Relief Act because it usurps the federal governments exclusive power to regulate immigration. 3rd U.S. Circuit Court of Appeals Chief Judge Theodore McKee wrote: “It is … not our job to sit in judgment of whether state and local frustration about federal immigration policy is warranted. We are, however, required to intervene when states and localities directly undermine the federal objectives embodied in statutes enacted by Congress….” This is the second strike for this contentious ordinance that has never been enforced because of court challenges. Maricopa County Superior Court Commissioner J. Justice McQuire continued “in full force”, the protective order granted to the estranged wife of Minuteman Civil Defense Corps founder and President Chris Simcox. “The court finds that conflicting testimony has been presented on every allegation and the court must make a determination of credibility. Defendant has a prior conviction involving dishonesty,” wrote Commissioner McQuire.
After mumbling and stumbling and walking away from reporters questions about her claims of beheadings in Arizona by drug cartels, Arizona Governor Jan Brewer has admitted, that maybe, she was wrong. “That was an error, if I said that,” the appointed Governor told The Associated Press and others on Friday. “I misspoke, but you know, let me be clear, I am concerned about the border region because it continues to be reported in Mexico that there’s a lot of violence going on and we don’t want that going into Arizona.
In a debate last night with Democratic challenger Terry Goddard, Gov. Jan Brewer was once again asked about the “beheadings” she claims have been happening in Arizona. It’s interesting her reaction. Before Forde defense attorney Eric Larsen left on vacation, he filed some documents in Pima County Superior Court outlining his defense strategy in the upcoming trial of Minuteman Shawna Forde, accused mastermind in the murder of 9 year old Brisenia Flores and her father Raul. This move was required under the Arizona Rules of Criminal Procedure.
