It appears that Minuteman Shawna Forde and her co-defendants won’t be held accountable anytime soon for their actions on the night of May 30, if their defense lawyers have their way about it.
In Pima County Superior Court Tuesday, attorneys for Minuteman Shawna Forde, 41, Albert Robert Gaxiola, 42, and Jason Eugene Bush, 35, told Judge John Leonardo that they believe the facts of the case necessitate separate trials.
Bush and Gaxiola were brought before Leonardo to discuss possible trial dates; Forde refused to be brought to court from the Pima County jail.
Judge Leonardo scheduled a Nov. 23 court date to discuss severing the cases. He also indicated that if the cases are separated, the first trial would likely be scheduled for January 2011.
Prosecutor Rick Unklesbay told the judge that he had given the defense attorneys almost all the evidence in the case, although he is still awaiting FBI and lab reports.
Justice delayed is justice denied! We’ll be seeing more of this maneuvering in the coming months unfortunately.
