NBPC continues trying to justify murder of Sergio Adrián Hernández Güereca

The union that represents non supervisory personnel of the US Border Patrol continues to rationalize and try to justify the murder of 15 year Sergio Adrián Hernández Güereca, by an unidentified member of their union.

Cesar Lujan with the NBPC says the teen was on the El Paso Most Wanted Juvenile list for smuggling. The border patrol allegedly keeps an internal list to keep track of teens involved in smuggling illegal immigrants.

So now it is an “internal” list instead of a public “Most Wanted List” as some have insinuated. Still, releasing details of a juveniles criminal history is against the law in both the United States and Mexico.

All the Border Patrol is allowed to do when juveniles are apprehended crossing the border illegally, is detain them briefly and deport them back to Mexico. They are not allowed to fingerprint them.

In Mexico, a juvenile 14 years of age or younger, cannot be arrested. It is a crime in Mexico to engage in human smuggling for profit or compensation, a charge frequently leveled and prosecuted.

However, illegal entry into the US is not a capital crime. But with the border patrol union making such a fuss about Hernandez being on this mystical “most wanted list”, one would have to wonder if perhaps the agent that killed him, didn’t recognize him and perhaps deliberately take aim on the kid. Looking at his actions in the video, it is quite possible.

HIGH PROFILE LAW FIRM TO REPRESENT FAMILY

There is rumblings that a high profile Houston law firm has signed on to represent the family of Hernandez in any upcoming court cases which are certain to arise from this tragedy. We don’t have confirmation yet but are working on it.

In the meantime, the family of Sergio Adrián Hernández Güereca has filed a formal complaint with the Human Rights Commission in Mexico. A formality to be certain, but a step in the right direction.
