Eric Larsen, defense attorney for Minuteman Shawna Forde, mastermind in the murder of 9 year old Brisenia Flores, has asked Judge John Leonardo to exclude a number of pieces of evidence from her trial next year.
Larsen is trying to keep the jury from knowing of accusations that Forde burglarized her brother’s home in Redding California after the murder and that she also invaded the home of her mother’s best friend.
Although witnesses and cell phone records put Forde at the scene of those crime as well as codefendent Jason Bush, Larsen points out that Forde’s never been arrested in those cases and claims there’s no direct evidence linking her to those crimes. No direct evidence other than witnesses to the crime.
Larsen also doesn’t want prosecutors to bring up the fact Forde says she was raped and shot at in Washington state in late 2008, early 2009. Nor does he want jurors to know Forde’s husband was shot and wounded in their home around the same time. The rape hoax was first revealed here at Immigration Clearinghouse and quickly went viral across the internet. He says those incidents are irrelevant, an assertion we disagree with as it shows the devious nature of Forde and her propensity for lying to gain attention to herself.
Authorities found camouflage clothing in Albert Gaxiola’s house after the Flores slayings and Larsen doesn’t want prosecutors to be able to say the clothing was women’s clothing or that they may have belonged to Forde.
In addition, Larsen doesn’t want prosecutors or Forde’s co-defendants’ attorneys to claim phone calls and texts made from a phone associated with Forde the night of the slayings were made or typed by Forde. He says no one can prove Forde was even in possession of the phone that night.
Larsen doesn’t mention it in his motion, but there’s evidence that someone sent text messages the morning after the slaying that said the ” competition” was gone and “cops on scene, stay low.”
Lastly, Larsen doesn’t want prosecutors to refer to Forde as the “leader” of Gaxiola and Jason Bush, who are also charged with murdering Flores and his daughter in May 2009.
Relatives of Forde have acknowledged she spoke to them about about robbing folks on the Arizona-Mexico border to fund her little 14 person border vigilante group, American Minuteman Defense, closely associated with Minuteman Project founder Jim Gilchrist and others, including border vigilante and fruitcake, Glenn Spencer, father of the “reconquista” theory.
