They’re both arrogant, consider themselves above the law and think rules only apply to the “little people” and have a inordinate craving to see their names in the spotlight as often as possible. But now, Sheriff Joe Arpaio and ALIPAC President William Gheen share something else in common. They’re both getting their “comeuppance”. They are both subjects of Federal lawsuits.
Sheriff Joe sued by US Department of Justice
After more than 17 months of waiting for “Nickle Bag” Joe Arpaio to comply with USDOJ requests to turn over documents relating to a probe of Civil Rights violation by his office and his deputies, and 17 months of Arpaio basically giving DOJ the finger, a lawsuit was filed this past week to force compliance.
Arpaio and the MCSO is required by law to cooperate with the feds’ inquiry under the auspices of Title VI of the 1964 Civil Rights Act, which “prohibits discrimination on the basis of race, color, and national origin in programs receiving federal financial assistance,” according to the DOJ’s Web site.
In the lawsuit, the USDOJ states: “The United States has determined that all administrative requirements have been exhausted,and securing compliance from Defendants cannot be achieved by voluntary means.”
And they are correct. Sheriff Joe has gone before the cameras and told DOJ that they will not cooperate. Instead, Ol’ “Nickel Bag” is now whining for more time and claiming everyones against him.
PNT put it best:
The DOJ needs to stop burning daylight and secure some indictments of Arpaio and/or his underlings in the criminal inquiry. Once Arpaio’s boy Bill Montgomery takes over the Maricopa County Attorney’s office after the general election, there will be no check on Arpaio’s power.
ALIPAC and it’s discredited President William Gheen hit with a Federal Copyright Infringement Lawsuit
It couldn’t happen to a more deserving person. Anti immigration website ALIPAC and it’s President William Gheen were served with a Federal lawsuit alleging copyright infringment by attorney’s for Stephens Media of Arkansas and one of their publications, The Las Vegas Review-Journal. Both entities represented by Righthaven LLC. More on them later.
The lawsuit alleges, quite rightfully that Gheen and ALIPAC infringed on a copyrighted article about Senator HArry Reid speaking at a Latino Summit back in the spring.
The lawsuits seeks a jury trial, damages of $75,000.00 and assignment of the domain name ALIPAC.us to the plaintiffs and the domain and successors locked from the internet.
As we write this, Gheen has not responded to the summons according to documents available on the PACER website of the Nevada District Court. Gheen, as is normal, released another arrogant and sophomoric press release announcing the lawsuit.
Gheen says;
“We stand ready to defend our free political speech and the free speech of all Americans against predatory companies like RightHaven and biased newspapers that would use the courts to try to generate revenue and silence the free speech of Americans. We intend to defend our organization, our rights, and our good name with every possible resource.”
He goes on to say;
“We will not allow ourselves or the online communities of America debating political issues to be intimidated or silenced by the aggressive legal ambush tactics of Righthaven and Las Vegas Review-Journal,” said William Gheen.
He goes on to howl about his civil rights being violated, his right to free political speech being assaulted, and claims the thousands of completely copied articles on his website (blatant copyright infringement) are protected under “FAIR USE” etc.
Willy needs to take a close look at “FAIR USE”. In the face of this lawsuit, one would think Gheen would at least make a token effort of remorse, but no, he still features the offending article on his website as if daring Righthaven LLC to do something about it.
And they are doing something about it. Demanding $75,000 and control of the domain.
To be fair about it. Willy is right in one aspect. This could be considered an ambush lawsuit. Righthaven LLC was formed by Stephens Media Group of Arkansas for this one express purpose. To troll the internet for content on mom and pop blogs, social activist blogs and websites and other venues. Once found, they acquire the copyright from Stephens and file Federal lawsuits which are usually settled out of court for a few thousand dollars. A sleazy business model to say the least, but effective.
And Gheen got his ass trapped. But instead of trying to rectify the situation, his arrogance and ego have him making all the ridiculous claims and accusations. One of his lemmings even goes so far as to suggest that Michelle Obama is behind the whole thing, as allegedly, she worked at one time with the head honcho, Steve Gibson at a law firm in Chicago.
As expected, Gheen is already making noises that he is going to need “donations” to pay for his defense. Let’s hope this time, his naive donors say, “enough is enough” and let him dig his way out of this hole he has dug for himself.
At best, this could be the beginning of the end for ALIPAC.us and it’s discredited President William Gheen.
