As expected, The US Department of Justice filed a lawsuit yesterday against Arizona’s darconian SB-1070, weeks before the law is scheduled to go into effect. SB 1070 “is pre-empted by federal law and therefore violates the Supremacy Clause of the United States Constitution,” legal papers filed Tuesday in U.S. District Court in Phoenix contend. The lawsuit says the legislation conflicts with the federal government’s need to balance the competing interests of enforcing federal immigration law with the country’s diplomatic relations with other nations, including Mexico.
In another blow to incarcerated Minuteman child killer Shawna Forde, the ACLU has rejected her recent complaint making various and sundry allegations against Sheriff Clarence Dupnik and the Pima County jail corrections staff. Forde had claimed she was a victim of “Massive Civil Rights Violations”as well as accusing Sheriff Dupnik of practicing White Racial Profiling (WRP) in the Pima County Jail, and to being in violation of the Civil Rights Act, Titles III and VI, and the Americans with Disabilities Act, as well as violating all her Constitutional rights. This breaking piece in the case of Minuteman child killer Shawna Forde, currently residing in the Pima County Jail waiting to answer charges in the brutal murders of 9 year old Brisenia Flores and her father Raul. According to the JFSF website,, which supports and defends the actions of Forde and her co-defendants, Forde has filed a 7 page complaint with the American Civil Liberties Union (ACLU), an organization much maligned by the right wingers, until they need their services.
As we posted yesterday, Jim Gilchrist, founder of the border vigilante group Minuteman Project, finds himself in the center of a firestorm of protests against his invitation to participate in a debate at University of Reno-Nevada. And as he did against Kyle de Beausset, Harvard undergraduate and publisher of CITIZEN ORANGE, Gilchrist is on the attack against the students and faculty of UNR and ASUN, who oppose his appearance.
