Pima County Superior Court Judge John S. Leonardo sentenced convicted murderer Albert Robert Gaxiola yesterday to natural life in the Arizona Department of Corrections for the May 30, 2009, murder of 9-year-old Brisenia Flores during the home invasion murder spree in Arivaca, led by Minuteman Shawna Forde. After a jury earlier could not decide on the appropriate punishment for Albert Gaxiola for the murder of 9 year old Brisenia Flores in May of 2009, Judge John S. Leonardo, during a hearing Friday, granted a prosecution motion withdrawing the death notice during a hearing Friday morning. Deputy County Attorney Rick Unklesbay told Leonardo that the Homicide Panel in his office has reviewed all the pros and cons of continuing to seek the death penalty for Brisenias murder, and with the full understanding and support of victim and mother Gina Gonzalez, the prosecution was taking the death penalty off the table. It shouldn’t have taken more than 5 minutes, but in the end, former Arivaca resident Albert Robert Gaxiola, 43, was found guilty of all charges in the home invasion murders of Raul Flores, and his 9 year old daughter Brisenia, and the attempted murder of the victims wife and mother, Gina Marie Gonzalez. Gaxiola was convicted of two counts of first-degree murder, one count of attempted first-degree murder, one count of burglary in the first-degree; one count of aggravated assault/serious physical injury; one count of aggravated assault, deadly weapon/dangerous instrument; one count of armed robbery; and one count of aggravated armed robbery. Prelims underway for the trial of Albert Gaxiola

Two years and a week after the murders of 9 year old Brisenia Flores and her father Raul, by convicted Minuteman Shawna Forde and Jason Eugene Bush, the trial of the third defendant is scheduled to begin. Albert Gaxiola faces the same charges as Forde and Bush were convicted of in the Arivaca Arizona home invasion robbery. 225 prospective jurors were summoned to the Pima County courthouse to file out questionnaires containing 39 questions concerning their suitability to be called as jurors in the case. Next week, attorneys for both sides will meet with the Judge to review the questionnaires and decide who should be excluded from initial questioning. Opening statements should begin on June 7. Testimony continued to move along today with the defense cross examining the widow of Raul Flores and mother of 9 year old Brisenia Flores in Minuteman Shawna Forde’s capital murder trial. Perhaps the highlight of the day was when prosecutors announced to the Court that their investigators had found Jason Bush’s girlfriend, Melinda Shelton and were going to have her testify. The stunned defense attorney Eric Larsen immediately objected saying they needed time to interview her and investigate her story. (another defense ploy to delay the trial) Prosecutor Rick Unklesbay replied Larsen shouldn’t be surprised because Shelton has always been listed on the witness list and had in fact, been scheduled to testify today. The jury has been seated in the capital murder trial of Minuteman Shawna Forde, and the trial begins in earnest tomorrow. A jury of 16 of her “peers”, 16, 14 women and 2 men, 4 of them alternates in the event one or more jurors become ill, or are dismissed for whatever reason, will sit in judgment of Forde, who is accused of orchestrating the home invasion robbery in Arivaca Arizona which left 9 year old Brisenia Flores and her daddy, Raul dead, and her mother, Gina Gonzalez, grievously injured. Attorneys for accused Minuteman child killer Shawna Forde, met with Judge John Leonardo and prosecutor Rick Unklesbay for a brief status conference Monday. Defense attorney Eric Larsen indicated he still has a couple of defense motions to present which will be argued on December 13. A tentative timeline follows: Jan. 5, Questionnaire to be given to prospective jurors to fill out and return to the Court Jan. 7, Attorneys meet to review and reject those jurors with obvious issues. Jan. 11, Remaining jurors brought into Court for more detailed questioning Jan. 18, Attorney tentatively plan opening statements. Attorneys expect the trial to last until the end of February.
