Pima County Superior Court Judge John S. Leonardo sentenced convicted murderer Albert Robert Gaxiola yesterday to natural life in the Arizona Department of Corrections for the May 30, 2009, murder of 9-year-old Brisenia Flores during the home invasion murder spree in Arivaca, led by Minuteman Shawna Forde. Prelims underway for the trial of Albert Gaxiola

Two years and a week after the murders of 9 year old Brisenia Flores and her father Raul, by convicted Minuteman Shawna Forde and Jason Eugene Bush, the trial of the third defendant is scheduled to begin. Albert Gaxiola faces the same charges as Forde and Bush were convicted of in the Arivaca Arizona home invasion robbery. 225 prospective jurors were summoned to the Pima County courthouse to file out questionnaires containing 39 questions concerning their suitability to be called as jurors in the case. Next week, attorneys for both sides will meet with the Judge to review the questionnaires and decide who should be excluded from initial questioning. Opening statements should begin on June 7. In a motion filed Tuesday,Defense attorney Richard Parrish said that there is such “overwhelming evidence” that Jason Bush was the triggerman in the murders of 9 year old Brisenia Flores and her father Raul,that he and co-counsel Chris Kimminau have no plans to offer any defense in his upcoming trial. They fear they “would entirely lose their credibility before the jury,” which would hamper them when they try to persuade not to impose the death penalty. For those interested, the automatic appeal of Minuteman Shawna Forde’s death sentence has been filed with the Arizona Supreme Court. This is all routine and could be many months before the Court makes a ruling. Not that it matters. Forde, currently residing on death row at ASPC_Perryville, has time on her hands and is not going anywhere.
