Albert Gaxiola and lawyers in court for status conference where excuses for his involvement disguised as "motions" were presented

July 12 saw a status conference for Minuteman Shawna Forde and her cohorts, charged in the home invasion murder of 9 year old Brisenia Flores and her father, Raul on May 30,2009. The day belonged to Gaxiola as his attorneys filed a slew of motions citing mitigating circumstances.

Jack Lansdale and Steven West also asked Judge John Leonardo to try Gaxiola separately from co-defendants Shawna Forde and Jason Bush. They claim there is no evidence Gaxiola was in the Flores house when they were shot and it would be unfair to try him at the same time as Bush, the shooter and Forde.

Bush is set to be tried in November of this year, Forde and Gaxiola in January 2011.

The lawyers also submitted to the Court and prosecutors a list of possible defenses, including;

  1. The state has insufficient evidence.
  2. Someone else was responsible.
  3. He didn’t intend for the crimes to occur.
  4. He wasn’t there when the crimes occurred
  5. He has a reputation for non-violence.

Pima County Jail Pod

Pima County "dungeon" and "chamber of horrors" where poor little Minuteman child killer is being held. Looks like some pretty swanky digs to me, for a jail.

In another blow to incarcerated Minuteman child killer Shawna Forde, the ACLU has rejected her recent complaint making various and sundry allegations against Sheriff Clarence Dupnik and the Pima County jail corrections staff.

Forde had claimed she was a victim of “Massive Civil Rights Violations”as well as accusing Sheriff Dupnik of practicing White Racial Profiling (WRP) in the Pima County Jail, and to being in violation of the Civil Rights Act, Titles III and VI, and the Americans with Disabilities Act, as well as violating all her Constitutional rights.

All of her constitutional rights? I guess she thinks she should be allowed to have a gun to play with, the right to vote, etc. etc?

Roberta Dilla aka “Laine Lawless” who maintains the site JUSTICEFORSHAWNAFORDE.com and insists her fantasy lover is nothing more than “an innocent white Christian Conservative patriot” being victimized by the system, had this to say about the outcome. Arizona nut job Laine Lawless

Arizona anti Mexican nutjob Laine Lawless is poised to release her fantasy book about Minuteman child killer Shawna Forde

Not surprised it happened, but anti-mexican nut job Roberta Dills aka “Laine Lawless” claims to be coming out with her book on Minuteman child killer Shawna Forde, titled, “Blonde on the Border”.

Lawless is the person responsible for the website JUSTICEFORSHAWNAFORDE.COM and SHAWNAFORDE.COM, the former where she tries to convince the public that Forde’s murderous rampage in Arivaca Arizona on the night of May 30,2009, is nothing more than a vast government conspiracy to frame a “petite American Patriot”. Shame of it is, some loony toons believe it. The latter, Lawless “speaks” as if she is Shawna Forde. Trite crap to say the least.

There is, was, an interesting conversation of someone who is allegedly Minuteman killer Shawna Forde, whining about her treatment in Pima County jail.

If it is her, she certainly has a foul mouth, so you’ve been warned, if you choose to read the transcript or listen to the actual conversation.

The audio file and transcript, originally posted on the website Justice for Shawna Forde, has since been removed, leading us to wonder whether it was phony.

Here’s the transcript;

I’m going crazy!  [I’ve had a] bad couple of days.

You know what?  I’m being tortured!

It sucks!  Are you kidding me?  Sometimes it’s hour by hour I have to pull myself through.

It breaks you down, you become more sensitive, and when your only contact with other human beings is fuckin’ bitch COs…[corrections officers]

It’s like have somebody come up and poke you in the middle of the forehead and tell me how long you can stand that until it starts driving you fuckin’ crazy…because that’s what it feels like to me.

It’s like, no human contact, except through the trap, or when I get to see my attorney.

And then you get a CO that has an attitude or a power trip, you know, that just fucks with you, you know, because they can, and…it’s HARD!

You know, I think a lot of people say, “Oh, I’d love to have that time to read a book, to have some me time,” but it’s like, yeah, but I don’t think you’re meaning for going on 9 months!

All the books here…they’re all about murder and crime!  I wrote something about that.  And people wonder why inmates leave jail enraged and then become worse criminals than when they came in…

I have some pretty good theories on that.  When you isolate someone for long periods of time, and then their only choice of reading material is books about murder and crime, I mean, it’s kind of like an inundation, you know!

And then society can’t figure out why people leave jail so angry and then re-offend.  But then, maybe after you go through a prolonged period, you get this rage of being mistreated, and you like fall through the cracks here.

And I think what amazes me too, is that in prison, it’s like a Holiday Inn!

(In jail) you’re innocent until you’re proven guilty; in prison, you’ve already been condemned and judged, but in prison, they have more rights than what they have in jail!

The thing is, I worked on a campaign for sheriff, I was the Chief of Police’s campaign manager, I have a lot of friends who are cops, I used to be 100% on their side, and I used to feel real judgmental towards criminals, and the system, and this and that, but I think now that actually coming and living on this side of it, it’s like wow!  What an eye-opener for me!

I’ve been on status now [Administrative Segregation, usually solitary) for 7 months, and I didn’t do anything to deserve that status, [she obeyed all the jail rules] and second, they have me on Isolation status, and that means that I am not allowed to talk to another human being!  And this is going on 9 months now.  So, if they want to keep me on status (Administrative Segregation), they need to lift the ISO (Isolation)!  It is torture, and it’s a bunch of bullshit, and you know I’m not gonna sit here and be a willing victim!

Just like, every day, you know, it’s like a struggle, every, every day, a constant struggle, just trying to figure out what…

If you could just imagine…lock yourself in a bathroom, take all your stuff out of that bathroom, you have nothing, and stay in there for 23 ½ hours, and only allow yourself 30 minutes to come out, and that’s the time you have to choose to use the phone or take a shower, and then you have to go back to your bathroom, shut the door and lock it.  Do that for just 2 days, and then you might get a taste of what I’m going through, going on 9 months.

I’ve already accepted the fact that I’m going to be here for 10 months.  I mean, honestly, I’ve already accepted that, OK?  I know, but I have to; if I don’t, it will just make me even more crazy, if I don’t surrender to the fact that this is what it’s gonna be.  I mean, hey, if something else happens, then it’s a blessing, but if nothing else happens, then it is what it is!

It’s nice that I can call you—it really helps, to have a conversation with somebody.  And I really, really, appreciate it probably more than you ever know!

A key witness in the case against Minuteman Shawna Forde,  Jason “Gunny” Bush and Albert Gaxiola, all accused of the home invasion murders of Raul and Brisenia Floresm has been placed under “intensive probation” for being a felon in possession of a weapon.

Oin Oakstar of Arivac Arizona was questioned about the slayings, but was ultimately only indicted for being a felon in possession of a weapon.

Facing a lengthy prison sentence, Oakstar agreed last month to plead guilty to the charge and testify against the three people indicted in the case if prosecutors would agree to a plea deal giving him probation and/or a reduced prison sentence.

On Tuesday, Pima County Superior Court Judge Jane Eikleberry chose to sentence Oakstar to intensive probation after prosecutor Rick Unklesbay and defense attorney Michael Rosenbluth said they thought Oakstar deserved a chance to prove himself. Oakstar could have been sentenced to as much as 3.75 years in prison.
