Washington State prosecutors appear satisfied with the sentence given to convicted double murderer Jason Eugene Bush and won’t try to extradite him to Washington state to stand trial for two more killings attributed to him. Bush, convicted triggerman in the home invasion murders of 9 year old Brisenia Flores and her father Raul, was also charged in Washington with the 1997 stabbing death of a homeless man in Wenatchee Washington and the shooting death of an 18-year-old white supremacist from East Wenatchee in July and September of 2007. Gaxiola escapes the death penalty for murdering 9 year old Brisenia Flores & father Raul

After a jury earlier could not decide on the appropriate punishment for Albert Gaxiola for the murder of 9 year old Brisenia Flores in May of 2009, Judge John S. Leonardo, during a hearing Friday, granted a prosecution motion withdrawing the death notice during a hearing Friday morning. Deputy County Attorney Rick Unklesbay told Leonardo that the Homicide Panel in his office has reviewed all the pros and cons of continuing to seek the death penalty for Brisenias murder, and with the full understanding and support of victim and mother Gina Gonzalez, the prosecution was taking the death penalty off the table. Prelims underway for the trial of Albert Gaxiola

Two years and a week after the murders of 9 year old Brisenia Flores and her father Raul, by convicted Minuteman Shawna Forde and Jason Eugene Bush, the trial of the third defendant is scheduled to begin. Albert Gaxiola faces the same charges as Forde and Bush were convicted of in the Arivaca Arizona home invasion robbery. 225 prospective jurors were summoned to the Pima County courthouse to file out questionnaires containing 39 questions concerning their suitability to be called as jurors in the case. Next week, attorneys for both sides will meet with the Judge to review the questionnaires and decide who should be excluded from initial questioning. Opening statements should begin on June 7. Minuteman Shawna Forde given max of 65 on remaining charges

Judge John S. Leonardo sentenced convicted double murderer and Minuteman Shawna Forde to an additional 65 years on the remaining charges she was convicted of  in February. She was sentenced to death for the murders of 9-year-old Brisenia Flores and her father Raul on May 30, 2009. Forde got the 65 years on attempted murder, burglary, aggravated assault and robbery charges. All sentences but one are to be served consecutively to the other including the death sentence for the murders. Arivaca Minuteman Murders - Two down One to go - Jason Bush received Death Penalty

Closing Arguments in the Shawna Forde murder trial and the jury is out

The ghost of playwright William Shakesphere was present in the courtroom on Thursday as defense attorney Eric Larsen quoted Act 5 Scene 5 of Macbeth in describing Shawna Fordes life as “A tale? told by an idiot, full of sound and fury signifying nothing.” And apt description but coming from her defense attorney? From there, he tried to deflect the blame from Forde and put it on Albert Gaxiolas former girlfriend Georgina Sue Moraga, claiming she was the short, fat white woman in the Flores home on the morning of May 30, 2009.
