Gaxiola escapes the death penalty for murdering 9 year old Brisenia Flores & father Raul

After a jury earlier could not decide on the appropriate punishment for Albert Gaxiola for the murder of 9 year old Brisenia Flores in May of 2009, Judge John S. Leonardo, during a hearing Friday, granted a prosecution motion withdrawing the death notice during a hearing Friday morning. Deputy County Attorney Rick Unklesbay told Leonardo that the Homicide Panel in his office has reviewed all the pros and cons of continuing to seek the death penalty for Brisenias murder, and with the full understanding and support of victim and mother Gina Gonzalez, the prosecution was taking the death penalty off the table. Prelims underway for the trial of Albert Gaxiola

Two years and a week after the murders of 9 year old Brisenia Flores and her father Raul, by convicted Minuteman Shawna Forde and Jason Eugene Bush, the trial of the third defendant is scheduled to begin. Albert Gaxiola faces the same charges as Forde and Bush were convicted of in the Arivaca Arizona home invasion robbery. 225 prospective jurors were summoned to the Pima County courthouse to file out questionnaires containing 39 questions concerning their suitability to be called as jurors in the case. Next week, attorneys for both sides will meet with the Judge to review the questionnaires and decide who should be excluded from initial questioning. Opening statements should begin on June 7. Convicted murderer Shawna Forde speaks for first time since arrest

Award winning journalist and Arizona based author Terry Greene Sterling scored an exclusive interview with convicted murderer Shawna Forde, hours after she was found guilt of the murder of 9 year Brisenia Flores, her father Raul and the attempted murder of Gina Gonzalez. Speaking to Forde via a videophone at the Pima County Adult Detention Center, Forde continued to maintain her innocence, despite the findings of a jury of 12 of her peers. Wearing glasses, no makeup, and black-and-white striped uniform of a convict, Forde told Sterling that she was “extremely saddened” by the verdict,, but took it “like a pro”, because she could not allow herself to “freak out” in public in front of her legions of supporters.

 
To the dismay of Shawna Forde supporters, Court upholds Arizona execution protocol

Arizona’s protocol for three-drug-injection executions has cleared another legal hurdle. A trial judge in Phoenix had upheld the state’s protocol, and a ruling by the San Francisco-based 9th U.S. Circuit Court of Appeals turns down seven Arizona death-row inmates’ appeal. The new ruling says the state’s protocol abides by standards set by the U.S. Supreme Court’s ruling on Kentucky’s similar protocol. And the appeals court says the state appears to be following its protocol.

Testimony in the first phase of Minuteman Shawna Fordes murder trial concluded this morning with the final defense witness helping to firm up the prosecutions case more than helping the defense as was intended. University of Washington experimental psychologist Geoffrey Loftus acknowledged during cross examination by Deputy Prosecutor Kellie Johnson that people are capable of accurately recalling events, even if those events are stressful and that not everyone’s memories evolve into inaccurate memories. Earlier, he had testified on direct, that stress can cause poor memories and poor memories often evolve into inaccurate recollections.
