Economic Boycott of Arizona to continue despite defeat of Anti Mexican legislation pushed by Russell Pearce

Arizona human rights group Puente, and activist Sal Reza issued a press release today indicating that they will continue to stand behind the successful  economic boycott against Arizona business until the draconian anti Hispanic SB-1070 is consigned to the trash heap of history, along with it’s author, Senator Russell Pearce. The press release states: “The Boycott will intensify and continue until SB1070 and other anti-migrant laws are repealed.” Said Raul Cordero. Henry Fernandez, a Senior Fellow at American Progress reflects on the lunacy in Arizona is the wake of the conviction and sentencing of Minuteman Shawna Forde, the shooting of Rep. Gabrielle Giffords and the political masturbation of Arizona’s nativist political machine. The national press has barely covered little Brisenia’s murder. The fact that Shawna Forde is, by my reading of the evidence, guilty of planning and ordering the executions of Brisenia and Raul Flores and the attempted killing of Brisenia’s mother, Gina Gonzalez, does not change that opinion. But I will try to be objective in looking at why the jury sentenced her to death. Putting myself in the place of a juror and seeing the evidence presented to the jury, it would be difficult to resist giving Forde the maximum penalty allowed by law. Two weeks ago,the 9th U.S. Circuit Court of Appeals upheld a 2009 ruling against Arizona rancher Roger Barnett, forcing him to pay about $87,000 in damages related to his assault of illegal immigrants on his ranch in 2004. The court ruled that Barnett was not entitled to claim self-defense because he admitted that none of the illegal immigrants had threatened or attacked him. In February 2009, a federal jury issued a split verdict in a case against Barnett stemming from the 2004 incident. The jury found that he didn’t violate the group’s civil rights and that he wasn’t liable on claims of battery and false imprisonment. PHOENIX – Federal Judge Susan Bolton has denied motions by Governor Jan Brewer and Sheriff Joe Arpaio to dismiss a lawsuit challenging the constitutionality of Senate Bill 1070. Bolton found that the plaintiffs, Friendly House and the American Civil Liberties Union, had standing to bring the lawsuit and that the moment was “ripe” to do so because of concerns surrounding unreasonable search and seizure and the “equal protection clause” which forbids unequal treatment for different classes of people or racial discrimination. Seven lawsuits have been filed in federal court against SB 1070. Two have been dismissed, and two have yet to be argued in front of Bolton.

The 9th U.S. Circuit Court of Appeals rejected arguments by nativist Sen. Russell Pearce, R-Mesa, that he has a “unique perspective” on SB 1070. Pearce, through his attorneys, said he wants a chance to convince the appellate judges that all provisions of the law are legal. DOJ lawsuit filed against Arizona & SB-1070 sets the stage for milestone ruling

As expected, The US Department of Justice filed a lawsuit yesterday against Arizona’s darconian SB-1070, weeks before the law is scheduled to go into effect. SB 1070 “is pre-empted by federal law and therefore violates the Supremacy Clause of the United States Constitution,” legal papers filed Tuesday in U.S. District Court in Phoenix contend. The lawsuit says the legislation conflicts with the federal government’s need to balance the competing interests of enforcing federal immigration law with the country’s diplomatic relations with other nations, including Mexico.
