Before Forde defense attorney Eric Larsen left on vacation, he filed some documents in Pima County Superior Court outlining his defense strategy in the upcoming trial of Minuteman Shawna Forde, accused mastermind in the murder of 9 year old Brisenia Flores and her father Raul.

This move was required under the Arizona Rules of Criminal Procedure.

The prosecutions theory is that Forde needed money for her little border vigilante group, MINUTEMAN AMERICAN DEFENSE, so she enlisted the aid of Jason Bush and Albert Gaxiola to rip off Raul “Jr.” Flores, a purported drug dealer.

Forde discussed this with others who are expected to testify for the prosecution, including two Colorado Minutemen and the star of the show, Oin Oakstar, who was supposed to be the fourth person but got too drunk and forgot to show up for the party.

Some of Larsen’s defense strategies were expected, such as “the state failed to prove their case,” but then, there were these others:

Is this nasty or what? Roberta Dills aka "Laine Lawless"

Apparently her social security checks not sufficient for food, Laine Lawless dines while threatening anyone who speaks the truth about her "friend" Minuteman child killer Shawna Forde, with copyright infringement and defamation lawsuits.

Robert Dills, who uses the moniker “Laine Lawless” is apparently upset with us for reporting the news about her friend Shawna Fordes legal troubles.

For those who don’t know Shawna Forde, she is the leader of Minuteman American Defense, a small group of 12, who took it upon herself to lead a small group of fellow Minutemen in the home invasion murder spree last year that resulted in the death of Raul Flores and his beautiful 9 year old daughter Brisenia. The crime was committed to fund her border vigilante activities and evidence shows it was one of many planned.

We updated our readers on the latest motions filed yesterday in Pima District Court by Fordes defense attorney’s resulting in this email from Dills/Lawless.

Eric Larsen, defense attorney for Minuteman Shawna Forde, mastermind in the murder of 9 year old Brisenia Flores, has asked Judge John Leonardo to exclude a number of pieces of evidence from her trial next year.

Larsen is trying to keep the jury from knowing of accusations that Forde burglarized her brother’s home in Redding California after the murder and that she also invaded the home of her mother’s best friend.

Although witnesses and cell phone records put Forde at the scene of those crime as well as codefendent Jason Bush, Larsen points out that Forde’s never been arrested in those cases and claims there’s no direct evidence linking her to those crimes. No direct evidence other than witnesses to the crime.

Shawna Forde Letter from jail

Paragraph from redacted letter written by Minuteman Shawna Forde detailing her lawful and comfortable treatment while incarcerated in the Pima County jail awaiting trial for the murder of 9 yo Brisenia Flores and her father Raul

Since the launch of the website JUSTICE FOR SHAWNA FORDE, established by supporters of Minuteman child murderer Shawna Forde, we’ve been treated to a barrage of allegations portraying Forde, not as the cold blooded killer she is, but as a “petite American Patriot” incarcerated unfairly and in inhumane conditions, by a government out “to get here”!

Roberta Dills aka Laine Lawless was the freakoid behind the website when it launched and until her recent mysterious resignation from the group, the driving force behind the website.

One of their main claims in support of Forde and their feeble attempts to rationalize her crime was this.

Shawna has now been TORTURED in Coercive Solitary Confinement for 419 Days! She has spent 1/3 of it “Stripped Out!”

For the last 70 days, she’s been shackled and chained, hand and foot, every time she leaves her cell!

Were this to be the truth, all of us would be outraged and demand an investigation into the allegations. But unfortunately, these accusations are from the mind of a real wingnut.

Immigration Clearinghouse recently was handed a letter which we have confirmed was written from the Pima County facility to someone close to her. It’s authenticity has been verified and at our request, has been redacted down to one paragraph to protect the identity of the recipient.

The portion of the letter that we were allowed to post reads:

Arrest of Minuteman Shawna Forde

"It's a brand-new team. They've been bled in." - Minuteman child killer Shawna Forde discussing Arivaca murders with FBI informants

Documents and audio tapes released in Pima County Superior Court this month, tie Minuteman Shawna Forde and Jason “Gunny” Bush to the murders of 9 year old Brisenia Flores and her father Raul on May 30, 2009.

Two confidential informants for the FBI say they told agents in April 2009 that Forde was recruiting people to raid a house she believed was filled with illicit drugs, money and guns. The informants were Colorado Minutemen as has been reported here and by reporter Scott North of the Everett Herald. The documents indicate neither was paid for his information, nor were they cooperating to avoid prosecution in any unrelated cases.

The documents say Forde, 42, and others were on the verge of hitting additional targets when she, Jason Bush, 35, and Albert Gaxiola, 43, were arrested on June 12, 2009.

According to Kim Smith of the Arizona Daily Star;

Albert Gaxiola and lawyers in court for status conference where excuses for his involvement disguised as "motions" were presented

July 12 saw a status conference for Minuteman Shawna Forde and her cohorts, charged in the home invasion murder of 9 year old Brisenia Flores and her father, Raul on May 30,2009. The day belonged to Gaxiola as his attorneys filed a slew of motions citing mitigating circumstances.

Jack Lansdale and Steven West also asked Judge John Leonardo to try Gaxiola separately from co-defendants Shawna Forde and Jason Bush. They claim there is no evidence Gaxiola was in the Flores house when they were shot and it would be unfair to try him at the same time as Bush, the shooter and Forde.

Bush is set to be tried in November of this year, Forde and Gaxiola in January 2011.

The lawyers also submitted to the Court and prosecutors a list of possible defenses, including;

  1. The state has insufficient evidence.
  2. Someone else was responsible.
  3. He didn’t intend for the crimes to occur.
  4. He wasn’t there when the crimes occurred
  5. He has a reputation for non-violence.

Did ya’ll get all of that? If not, read it again.
