Ninth Circuit Court of Appeals Rejects Gov. Brewer’s Challenge, Upholds Injunction of SB 1070

FROM F I R M Today the 9th Circuit Court of Appeals refused to lift an injunction on the most controversial aspects of SB 1070, including the provision that required police to verify the immigration status of anyone they suspected of being undocumented. TPM reports: The Ninth Circuit Court of Appeals on Monday struck down Arizona Gov. Jan Brewer’s appeal of a preliminary injunction against the state’s controversial immigration law, upholding the decision by a District Court judge to block key parts of the law until the Justice Department’s lawsuit against it is decided. PHOENIX – Federal Judge Susan Bolton has denied motions by Governor Jan Brewer and Sheriff Joe Arpaio to dismiss a lawsuit challenging the constitutionality of Senate Bill 1070. Bolton found that the plaintiffs, Friendly House and the American Civil Liberties Union, had standing to bring the lawsuit and that the moment was “ripe” to do so because of concerns surrounding unreasonable search and seizure and the “equal protection clause” which forbids unequal treatment for different classes of people or racial discrimination. Seven lawsuits have been filed in federal court against SB 1070. Two have been dismissed, and two have yet to be argued in front of Bolton.

DOJ lawsuit filed against Arizona & SB-1070 sets the stage for milestone ruling

As expected, The US Department of Justice filed a lawsuit yesterday against Arizona’s darconian SB-1070, weeks before the law is scheduled to go into effect. SB 1070 “is pre-empted by federal law and therefore violates the Supremacy Clause of the United States Constitution,” legal papers filed Tuesday in U.S. District Court in Phoenix contend. The lawsuit says the legislation conflicts with the federal government’s need to balance the competing interests of enforcing federal immigration law with the country’s diplomatic relations with other nations, including Mexico.
