The 3rd U.S. Circuit Court of Appeals in Philadelphia, ruled Thursday that Hazleton, Pa., may not enforce its Illegal Immigration Relief Act because it usurps the federal governments exclusive power to regulate immigration. 3rd U.S. Circuit Court of Appeals Chief Judge Theodore McKee wrote: “It is … not our job to sit in judgment of whether state and local frustration about federal immigration policy is warranted. We are, however, required to intervene when states and localities directly undermine the federal objectives embodied in statutes enacted by Congress….” This is the second strike for this contentious ordinance that has never been enforced because of court challenges. Gilchrist still has his panties in a bunch after having his much anticipated invitation to speak at a Harvard Law symposium.
