The Department of Justice, Civil Rights Division, is apparently fed up with Maricopa County Sheriff Joe Arpaio refusal to cooperate with their investigation into allegations of discrimination and unconstitutional searches and seizures. In a letter sent to Arpaio today, Assistant Attorney General Thomas Perez gave the Sheriff’s Office until Aug. 17 to cooperate with the investigation, and to turn over documents requested last year for an inquiry into claims of discrimination based on national origin. DOJ lawsuit filed against Arizona & SB-1070 sets the stage for milestone ruling

As expected, The US Department of Justice filed a lawsuit yesterday against Arizona’s darconian SB-1070, weeks before the law is scheduled to go into effect. SB 1070 “is pre-empted by federal law and therefore violates the Supremacy Clause of the United States Constitution,” legal papers filed Tuesday in U.S. District Court in Phoenix contend. The lawsuit says the legislation conflicts with the federal government’s need to balance the competing interests of enforcing federal immigration law with the country’s diplomatic relations with other nations, including Mexico.

Mexico gets to have a say in one of the lawsuits challenging Arizona’s immigration enforcement law. A US District Court Judge Susan Bolton on Thursday granted Mexico’s request to be allowed to file a legal brief supporting the challenges to Arizona’s draconian and controversial SB-1070. What this means is the Court will consider the amicus curiae brief Mexico submitted previously. Sources are suggesting that Arizona Sheriff Joe Arpaio will be making an announcement next week, possibly on Tuesday of his plans to run for Governor of Arizona. IMMIGRATION CLEARINGHOUSE supports and endorses Sheriff Arpaio in his quest to unseat Governor Jan Brewer. Republican Party Chairman Randy Pullen said he has spoken with the Sheriff on several occasions about running for governor.
